1. Scope of Application and Responsibility 

BIOSANI – Agricultura Biológica e Protecção Integrada, Lda., with tax number (NIPC) 503255785, hereinafter referred to as Biosani, carries out commercial and research activities in the field of plant protection, having as one of its commitments the protection of the privacy of the personal data it collects, across the various areas of its activity. 

With the entry into force of the General Data Protection Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April (GDPR) on 25 May 2018, Biosani's commitment in this matter is made evident. 

Biosani is not responsible for and does not provide any guarantees regarding other websites that may be accessed through a hyperlink on the Biosani website.

In addition, it is up to the user to take precautions and ensure that the information they obtain does not contain features of a harmful nature. 

The use of the website www.biosani.com, as well as any interaction, commercial or otherwise, with Biosani, as well as the processing of the personal data provided by its owner, is subject to the following conditions set out in the points presented below. 
 

 

2. Use of the Website 

The Biosani website must be used exclusively for personal use. Its modification, reproduction, duplication, copying, distribution, sale, resale and other forms of exploitation, with or without commercial purposes, are expressly prohibited. The intellectual property rights over the website and its contents belong to Biosani, unless otherwise stated. 

Biosani grants only a limited, non-exclusive and non-transferable licence to view or print the content of the website for exclusively personal and non-commercial use. 

Biosani undertakes not to use this website for illegal or prohibited purposes. 
 

 

3. Data Collection 

The entity responsible for the collection, processing and storage of personal data is Biosani, with its registered office at Quinta de S. Brás, Serra do Louro, 2950-354 Palmela, with legal person and registration number 503 255 785. 

For data protection purposes, Biosani may be contacted at the address identified above, by registered letter with acknowledgement of receipt, or alternatively by email at info@biosani.com. 

The collection of your data arises from the specific interaction with Biosani and may have one or several purposes, such as: 

  • Contact, establishment and management of commercial relationships; 
  • General requests for information; 
  • Downloading of documentation; 
  • Recruitment processes or spontaneous applications; 
  • Carrying out diagnoses; 
  • Sending of institutional information, advertising or marketing, when consented to; 
  • Complaints and suggestions. 

Depending on the nature of the interaction and only when necessary, Biosani may need to collect and process some personal data, such as: name, email address, address/locality, telephone, civil identification or tax identification document number, date of birth, sex, nationality, academic qualifications, professional situation and/or banking/payment data.

Biosani collects and processes only the data strictly necessary to pursue its specific purpose, namely to: 

  • Provide an adequate and targeted response to requests for information/proposals; 
  • Communicate better with you, on relevant matters and only with the necessary frequency, according to the characterisation of your data and preferences; 
  • Fulfil business purposes, namely statistical data to improve the performance of the various services provided; 
  • Comply with the requirements of accreditation bodies, on which the validity of the certificates of some of the services provided depends; 
  • Invoice products/services. 

 

4. Data Retention Period 

Personal data will be retained by Biosani for the time necessary for the proper fulfilment of the purpose for which it was collected and other legal requirements, and may be retained until the end of the limitation period for any actions or legal proceedings arising from the conclusion of the contract or connected with it. 

Where personal data has been collected on the basis of consent, it will be retained until the owner exercises the right to object to the continued processing of their data, unless another basis arises. 

The retention periods for your data may change significantly when archiving purposes in the public interest, historical, scientific or statistical reasons are involved, with Biosani undertaking to adopt appropriate retention and security measures.  

 

5. Data Sharing 

Biosani may use subcontractors, namely for accounting, consultancy and IT support and litigation management purposes, with these entities being obliged to develop the technical and organisational measures appropriate to the protection of the owner's data and with a view to exclusively fulfilling the stated purposes. 

Where applicable, Biosani may share the data owner's information with: 

  • Entities that regulate the issuance of training certificates; 
  • Regulatory entities, for the purpose of verifying the compliance of the activities provided by Biosani. 

Biosani reserves the right to change or use other subcontractors, without this altering the basis or purpose of the data processing. 

 

6. Rights of Data Owners 

The data owner has the right, at any time, under the terms and for the purposes of the provisions of articles 12 to 22 of the GDPR, to request: 

  • Access to the personal data concerning them and to the information provided for in the GDPR. 
  • Rectification or erasure, without undue delay, including the exercise of the right to restriction and to be “forgotten”, when, there being no other legal basis for the said processing: 
  • The personal data is no longer necessary for the purpose that motivated its collection; 
  • The owner withdraws consent, applicable only to cases where this is the basis for the collection and processing of data; 
  • The owner objects to its processing, beyond the maximum retention period; 

The restriction of the processing of your data, if one of the following situations applies: 

  • You have contested the accuracy of the personal data, for a period that allows the controller to verify its accuracy; 
  • The processing is unlawful and the data owner objects to the erasure of the personal data and requests, instead, the restriction of its use; 
  • The controller no longer needs the personal data for processing purposes, but this data is required by the owner for the purpose of declaring, exercising or defending a right in legal proceedings; 
  • If you have objected to the processing, until it is verified that the legitimate grounds of the controller prevail over those of the data owner. 
  • The portability of your data, so that the data owner can transmit it to other data controllers, if the processing is based on consent or the processing is carried out by automated means; 
  • Not being subject to automated individual decisions, including profiling; 
  • The right to withdraw consent at any time, provided that this is the basis for the collection and processing of data, without such withdrawal compromising the lawfulness of the processing carried out on the basis of the consent previously given up to the date of its withdrawal; 
  • Without prejudice to the data owner being able to complain to Biosani, the data owner may submit a complaint to the National Data Protection Commission (Rua de São Bento, n.º 148, 3.º, 1200-821 Lisboa; Telephone – +351213928400; fax – +351213976832; email – geral@cnpd.pt) or to any other supervisory authority that may be created for this purpose. 

Such rights must be exercised in writing by registered letter with acknowledgement of receipt to the address located at Quinta de S. Brás, Serra do Louro, 2950-354 Palmela or alternatively to the email address info@biosani.com .

For reasons of security and data protection, when exercising any of the above-mentioned rights, the controller may require a document proving the identity of the data owner. 

Biosani centralises all matters relating to data protection through the email info@biosani.com.  

 

7. Security of Personal Data 

Biosani has implemented a set of appropriate security technologies and procedures to protect your Personal Data from unauthorised access, use or disclosure, access control and monitoring of databases and information systems, through security policies aligned with the best information security practices, ensuring adequate auditing and monitoring, and accountability of access. 

 

8. Cookies 

In order to provide a better service to the user, we use cookies, which are small text files that are placed on the hard drive by a website server. The Biosani website may require cookies to be accepted, so that you can have access to all available functionalities. 

Cookies, when consented to, will be used by Biosani to: Collect users' IP addresses. The aim is to personalise the user's preferences and facilitate the use of the services.

The cookie identifies the user and, if they are registered for any service, promotion or event promoted by Biosani, it gives an order for the system to access the stored information about the users. Carry out statistical studies that allow the number of users and their growth to be calculated. Find out whether users have viewed a certain part of the website, avoiding repetition of the same. You can always limit or restrict the admission of cookies through your browser's options. 

 

9. Limitation of Liability

The Biosani website may provide “links” to external “sites” for your convenience and information. When you access these “links” you will leave the Biosani site. Biosani does not control these sites or their privacy policies, which may differ from those of Biosani. Biosani does not represent these sites.

Biosani's Privacy and Data Protection Policy does not cover the personal data that the user may provide to sites external to Biosani. 

Biosani does not sponsor any website that has links to its website. Biosani is not responsible for the content of those websites. However, the Internet being a worldwide network of computers, any information sent or transmitted by you will necessarily be routed through third-party computers. 

Biosani is not responsible for failures in the security of communications and assumes no responsibility for the improper use of its information by third parties. The user, however, will be responsible for the content of the information sent or transmitted to the Biosani website. 

Biosani acknowledges that access to and use of its website may suffer interruptions and that the website information may contain bugs, errors, technical faults, problems or other limitations and that access may be impossible at certain times. Biosani is not responsible for any damage caused by the use of its website. To the maximum extent permitted by law, Biosani disclaims any liability, direct or indirect, for the use of its website.

Biosani may change this Privacy and Data Protection Policy at any time, in order to reflect the comments received and whenever justified. These changes will be duly publicised on the site www.biosani.com/politica-de-privacidade

We therefore recommend that you periodically consult our privacy policy to stay informed about the way in which Biosani protects your Personal Data and to stay up to date on the information and rights to which you are entitled. 

 

11. Applicable Law and Competent Jurisdiction 

This Privacy and Data Protection Policy is governed by Portuguese law. 

To settle all questions and disputes that may arise, inherent to the application of these Terms and Conditions, the jurisdiction of the District of Setúbal is exclusively competent, with express waiver of any other.
